Terms of Service
Effective date: October 8, 2026 · InterVolt Development, Ontario, Canada
1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the InterVolt Development website and any services provided by InterVolt Development ("InterVolt", "we", "us", or "our"), a web development, branding, and digital services business operating in Ontario, Canada.
By accessing our website, submitting an inquiry, or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
2. Our Services
InterVolt Development provides professional digital services including, but not limited to: custom website design and development, content management systems (CMS), eCommerce solutions, search engine optimization (SEO), branding and digital identity design, AI integrations and automation, and ongoing website growth and maintenance plans.
The specific scope, deliverables, timelines, and pricing for any project will be set out in a written proposal, statement of work, or service agreement between you and InterVolt Development. In the event of a conflict between these Terms and a signed service agreement, the service agreement will govern.
3. Quotes, Pricing, and Payment
Prices displayed on our website, including website startup plans and growth plans, are starting points and may vary based on the final agreed scope of work. All prices are quoted in Canadian dollars unless otherwise stated and are subject to applicable taxes, including HST.
Payment terms, deposit requirements, and billing schedules will be outlined in your project agreement. Recurring services such as hosting, maintenance, and SEO plans are billed in advance and renew automatically unless cancelled in accordance with your agreement.
Late payments may result in a pause of work or suspension of services until the account is brought current.
4. Client Responsibilities
You agree to provide accurate information, timely feedback, and any content, materials, or access credentials reasonably required to complete your project. Delays in providing required materials may extend project timelines.
You represent and warrant that you own or have the legal right to use all content, images, logos, and materials you supply to us, and that such materials do not infringe the rights of any third party.
5. Intellectual Property
Upon receipt of full payment, you will own the final delivered website design, custom code, and content created specifically for your project, except for: (a) third-party software, frameworks, libraries, fonts, and plugins, which remain subject to their own licences; (b) any pre-existing tools, templates, or proprietary methods used by InterVolt Development, which remain our property; and (c) stock assets, which are licensed for use within your project only.
InterVolt Development retains the right to display completed work in our portfolio, case studies, and marketing materials unless otherwise agreed in writing.
6. Revisions and Approvals
Each project includes a reasonable number of revision rounds as defined in your proposal. Additional revisions, scope changes, or new features requested after approval may be billed at our standard hourly rate or quoted separately.
Once you approve a deliverable or a project launches, further changes are considered new work.
7. Hosting, Maintenance, and Third-Party Services
Hosting, maintenance, and growth plans are provided on a best-efforts basis and depend in part on third-party infrastructure, platforms, and providers. While we work hard to keep your website fast, secure, and online, we do not guarantee uninterrupted availability and are not responsible for outages caused by third-party providers, domain registrars, or circumstances beyond our reasonable control.
If your project relies on third-party services (such as payment processors, email platforms, or analytics tools), you are responsible for complying with those services' own terms and any associated fees.
8. Warranties and Disclaimers
We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. Beyond this, our website and services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
While we apply proven SEO and performance practices, we do not guarantee specific search engine rankings, traffic levels, or revenue outcomes, as these depend on many factors outside our control.
9. Limitation of Liability
To the maximum extent permitted by law, InterVolt Development's total liability for any claim arising from or related to our services is limited to the amount you paid us for the services giving rise to the claim in the twelve (12) months preceding the claim.
In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
10. Confidentiality
We treat your business information, project details, and any non-public materials you share with us as confidential and will not disclose them to third parties except as required to deliver your services or as required by law.
11. Termination
Either party may terminate a service agreement as set out in that agreement. Upon termination, you are responsible for payment of all work completed and expenses incurred up to the termination date. Recurring plans may be cancelled with notice as described in your plan agreement; prepaid amounts are non-refundable except as required by law.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Ontario.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with the effective date. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
